Scooters Motorworks reserves the right, at any time, to modify, alter, or update these Terms of Use, and you agree to be bound by such modifications, alterations, or updates.

Typographical Errors:
Scooters Motorworks features high quality products at very competitive prices. However, from time to time typographical errors, or price changes occur which are beyond our control. Scooters Motorworks maintain no responsibility for these kinds of inadvertent errors or manufacturer price changes and we reserve the right to make price changes as necessary.

Warranties and Guarantee's:
All warranties and guarantee's, including missing items, are handled directly by the original manufacturer of that item and should be sent to them, not Scooters Motorworks.  Due to the high performance nature of the items we sell there are no returns on any opened or electronic merchandise. The exception is any Scooters Motorworks labeled product. Scooters Motorworks will handle all warrantee problems as stated on your warrantee sheet with your product.

Address Verifications:
To insure the security of the card holder, we do a thorough address verification on all credit cards. If we cannot verify the address, we cannot ship the order.  First time customers can only ship orders to the verified billing address of the credit card holder.

Shipping and Backordered items:
Shipping Charges are non-refundable.  Back ordered items are subject to the same shipping charge. These are regular orders, and it costs the same to ship as the original order. If the sum of the backordered items adds up to less than $10 worth of merchandise, it will be cancelled. You may cancel any backorder you have at any time before it is shipped. Orders received after 12:00pm Eastern Standard Time may not ship the same day. All backorders over 90 days old are subject to cancellation. Orders could take as long as 72 hours to process and ship. If it will take longer than that you will be notified.

International destinations: Scooters Motorworks can ship orders just about anywhere in the world. Shipping costs are estimated and includes a minimum of $9.95 for handling. This is done to cover all the additional customs and paperwork we have to do for your international order. Conditions around the world and countries import laws change, or other issues occur that keep us from being able to ship an order to you. We are presently unable to ship to the following countries: Afghanistan, Bolivia, Brunei, Columbia, Cuba, Indonesia, Iraq, Lebanon, Malaysia, North Korea, Peru and Venezuela.

Returns:
There is a 15% re-stocking fee on all returned merchandise. Due to the high performance nature of the items we sell there are no returns on any opened or electronic merchandise. No returns, without written authorization, or after 30 days. No returns on items we have marked as discontinued, are no longer available on our website or that we are closing out.

Order Minimums:
$10 merchandise minimum per order.

Tax:
All Ohio Residents are subject to a 7.75% sales tax. 

Payment:
We take payment in the following forms: All major credit cards, including. Visa, MasterCard, Discover, We also accept money orders, wire transfers and personal checks.  Personal checks take 14 days to clear.

Use of any site content by you or other third parties for purposes other than placing an order with Scooters Motorworks. It is expressly forbidden to use this site as a shopping resource for other businesses. Such use violates the copyright laws, trademark laws, privacy laws and other laws and regulations. Nothing contained on this site may be construed as granting any license or right to use any of our trademarks or service marks without our prior written consent.

Trademarks:
All trademarks, service marks, and trade names that appear on our site are proprietary to Scooters Motorworks, or other respective owners that have granted Scooters Motorworks the right and license to use such marks.

Disclaimer for Promotions:
Certain offers may only apply to first time customers. Only one discount per household may be allowed. These offers may not be valid with any other coupons or discounts and may not be applied to previously placed orders. Coupons have no cash value. Scooters Motorworks reserves the right to set minimum purchase amounts required to qualify for any special offers.

Order Acceptance:
The receipt of an e-mail order confirmation does not constitute the acceptance of an order or a confirmation of an offer to sell. Scooters Motorworks reserves the right, without prior notification, to limit the order quantity on any item and/or refuse service to any customer. Verification of information may be required prior to the acceptance of any order.  Credit card billing information you supply to us must match the billing information that the credit card company has on file for that card or your order can not be processed using that card.

Limitation on Liability:
Scooters Motorworks will not be liable for any direct, indirect, special, punitive, incidental, exemplary or consequential damages, or any damages whatsoever, even if Scooters Motorworks has been previously advised of the possibility of such damages, whether in an action under contract, negligence, or any other theory, arising out of or in connection with the use, inability to use, or performance of the information, services, products, and materials available from this site. These limitations will apply notwithstanding to any failure of essential purpose of any limited remedy.
